Welcome to NearSkills. These Terms & Conditions govern your access to and use of our service listing web application. By using NearSkills, you agree to comply with these Terms. If you do not agree, please do not use the platform.

2. Platform Role & Service Listing

NearSkills operates solely as a service listing platform that connects clients with independent service providers. We do not employ service providers, nor do we control the manner in which they perform services.

3. Fees & Payments

• No Platform or Service Fee for Clients: Clients are not charged any platform fee or service fee by NearSkills.
• Provider Joining Fee: Service providers may be required to pay a one-time or recurring joining fee to list their services on NearSkills. The details of any such fee will be communicated to providers during registration.
• Payments Between Client & Provider: All payments for services are made directly between the client and the provider. NearSkills does not accept, hold, process, or mediate payments for services booked through the platform.
• No Payment Liability: We are not responsible for any payment disputes, refunds, cancellations, or chargebacks that occur between clients and providers.

4. Provider Responsibilities

Service providers are solely responsible for:

• Providing accurate, truthful, and up-to-date information about their services.
• Setting their own prices, availability, and terms of service.
• Delivering services to clients in a professional and lawful manner.

5. Client Responsibilities

• Clients must provide accurate information when booking or communicating with providers.
• Clients should verify provider credentials, reviews, and service details prior to booking.
• Clients and providers should communicate clearly and resolve any disputes between themselves.

6. No Warranty & Limitation of Liability

NearSkills provides the platform "as is" and does not guarantee the quality, safety, legality, or suitability of services offered by third-party providers. To the fullest extent permitted by law, NearSkills (including its directors, employees, partners, and affiliates) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the platform or from interactions between users and providers.

7. Data Protection & Privacy

We value your privacy. NearSkills does not sell or rent personal information to third parties. We take commercially reasonable measures to protect user data. For full details, please refer to our Privacy Policy.

8. Prohibited Conduct

Users (both clients and providers) must not use NearSkills to:

• Post fraudulent, illegal, or harmful content.
• Share sensitive personal data of others without consent.
• Attempt to bypass our platform for payments or to avoid fees owed to the platform (where applicable).

9. Termination

We reserve the right to suspend or terminate access to users who violate these Terms or engage in harmful or unlawful conduct.

10. Changes to Terms

NearSkills may update these Terms from time to time. If we make material changes, we will provide at least 30 days' notice. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where NearSkills operates, without regard to conflict of law principles.
